General
These Terms and Conditions ("TC") set out the legal terms that apply to your use of our website libascollective.com, any of its sub-domains and any other websites operated by us or on our behalf and any mobile device application or desktop application developed by us or on our behalf (together, the "Websites" and "Website" being a reference to any one of them) and the other services that we provide (the "Services").
Please read these Terms and Conditions carefully and make sure that you understand them before using the Services. Please note that by using the Services, you agree to be bound by these TC. If you do not accept these TC, you will not be able to use the Services and you should leave the Website immediately. If you continue to use the Website or if you order products, we will take this as your acceptance of these TC.
When we refer to "Libas Collective", "Libas", "we", "us" or "our", we mean Libas Collective Trading LLC, company registered in Dubai, United Arab Emirates and our registered office is at 39, Marasi Drive Street, 2104, Prime Tower - Dubai, United Arab Emirates. Our trade license is registered with number 54537 from Dubai Integrated Economy Zones and Government of Dubai.
Where we refer to "User", "Seller" or "Buyer" we mean you, the person using the Services.
Description
Libas provides Users with online access to buy and sell products. Users shall be responsible for obtaining access to the Services, and that access may involve third-party fees, such as internet service provider or airtime charges. In addition, you must provide all equipment necessary to access the Services, for which you shall also be responsible.
Registration Account
By making use of the Services, you confirm that you are of legal age to enter a binding contract and are not a person interdicted from receiving services under the laws of the UAE or other applicable jurisdiction. You also agree to provide true, accurate, current, and complete information about yourself as stated by the registration form. If any information provided is false, inaccurate, outdated, or incomplete (or becomes false, inaccurate, outdated, or incomplete, or Libas had reasonable grounds to suspect that such information is false, inaccurate, outdated or incomplete, the latter has the right to suspend or terminate your account and refuse any and all current or future use of the Services. If you use the Services, you are responsible for the confidentiality of your account and password, and for restricting access to your computer. You agree and accept holding full accountability of all activities affiliated with your account or password. By reason, we strongly recommend that you exit from your account at the end of each session. You agree to notify Libas immediately of any unauthorized use of your account of security. Libas reserves the right to refuse service, terminate accounts, and remove or edit content in its sole discretion.
License And Application Access
Libas grants you a limited license to access and make personal use of the Services. This license does not include any downloading or copying of account information for the benefit of another vendor or any other third party; in addition to caching, the framing of any content available through the Services, uploading, posting, or transmitting any content that you're not entitled to make available; uploading, posting, or transmitting any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment; any action that imposes or may impose on Libas an unreasonable or disproportionately large load, or any use of data mining, robots, or similar data gathering and extraction tools. You may not bypass any measures used by Libas to prevent or restrict access to the Services. Any unauthorized use shall terminate the license.
Sellers Commission Fee Structure
Listing your items is free on our Services. As of January 15, 2024, listings will include a new and enhanced commission model for all sellers.
Service commissions are as follows:
A) 10% of the final sale price for all items below $20,000 USD or the equivalent in your local currency.
B) Fixed $2000 USD for items priced above $20,000 USD or the equivalent in your local currency.
3% payment processing fee is applied to full item price in addition to the above commission rates.
We are not accepting items for sale below $300 USD or the equivalent in your local currency.
Note that our commission is non-negotiable and not open for discussion or any exceptions.
Sellers Additional Terms
By agreeing to sell on the Services, the Seller is deemed to agree to pay the commission applicable for selling the Item(s). When listing their items, Sellers agree that the item will be made available for sale, and customers can place orders at any time. It is important to note that all sales are final, and Sellers are unable to modify the selling price once an item has been ordered. Sellers bear the responsibility and the duty to actively manage their inventory. They should also promptly unlist or delete items that are no longer available for sale or that they no longer wish to sell.Sellers are responsible for ensuring that all listed products are in their possession and ready for immediate dispatch upon order confirmation. Any attempt to list products without actual stock availability may result in listing removal, account suspension, or termination.
Once a sale is confirmed, you have 7 days to ship your item. Orders not shipped within this period will be automatically cancelled, with a full refund issued to the buyer. Shipping after 7 days means no guaranteed payment. Failing to ship an order after it has been placed can result in disappointment for customers and have a detrimental effect on a seller's store reputation and visibility. Consistent failure to fulfill orders may lead to permanent account suspension.
If the item is subject to authentication and physical inspection, and during this process it is found to be counterfeit or does not match the description and/or photos provided in the listing, the order will be canceled. The item will be returned to the Seller, who will be responsible for all associated costs, including shipping to and from our authentication center, authentication fees, and any applicable duty or other taxes. The item will be delivered back only after all pending costs are cleared from the seller. If the costs are not settled within 30 days, the item will be permanently destroyed.
The Seller shall receive and collect their share of money from Libas via bank transfer only. Any additional charges the bank or intermediary bank shall impose are to be borne by the Seller.
Communicating with buyers outside of the platform can lead to account suspension or termination, as well as put your personal information and security at risk. All communication and transactions should be kept within the Libas Services.

Drop Shipping
We do not accept drop shipping or listings where the seller does not directly hold inventory. Items sourced from third-party warehouses or fulfillment centers that are not under the seller's direct control are strictly prohibited. All items listed for sale on our marketplace must be physically available with the seller at the time of listing. Sellers must have direct possession of the products they are offering to ensure timely fulfillment and accurate representation.
Seller Product Listing
The seller must provide an honest and accurate description of the item, including the brand, any visible wear, damage, or customizations. Photos and descriptions must not be misleading. If the item has been altered (e.g., customized or personalized), this must be clearly disclosed on the product page.
All product listings are subject to review and approval by Libas. Libas reserves the right to reject or remove any listing at its sole discretion, particularly if it violates the seller terms. Sellers are solely responsible for the accuracy and content of their listings.
Once approved, Libas will confirm the product price and applicable commission via email.
To keep your listings active, your account must remain active. Listings from users who haven't logged in for over 90 days will be removed.
Please refer to our Item Condition Guidelines to ensure your listing meets our quality standards and is categorized under the appropriate condition.
Price Reduction
From time to time we run promotions or issue vouchers. Libas reserves the right to reduce the Seller Item price by deducting from its commission without notice. The Seller may perform a price reduction after the listing was published without notice to Libas.
Buyer Service Fee
The buyer service fee is charged to the buyer and covers essential services like:
a) Secure Delivery Promise: Your order is guaranteed to arrive safely, or we'll provide a full refund.
b) Comprehensive Listing Check: Every item is thoroughly reviewed online, so you can shop with peace of mind.
c) Free re-listing: Not satisfied with your purchase? You can quickly list it for resale within 3 days of receiving it with no service commission.
d) Reliable Support Anytime: Whether by chat or message to our customer support team, we are here to assist you whenever you need help.
The buyer service fee of 3% to 14% is in place to provide an unparalleled experience to our community. The buyer service fee varies based on a variety of factors and may be higher or lower depending on factors such as the country of residence of the buyer and whether the seller is a private individual or a professional. The buyer service fee for a specific item can be found by clicking the price details info icon ℹ️ next to the displayed price and at checkout before you confirm and pay for your order. The buyer service fee includes, where applicable, Value Added Tax (VAT), Goods and Services Tax (GST), US Sales Tax, and equivalent consumption taxes.
Buyers Terms
This section constitutes a binding agreement between the User referred to as "Buyer" and Libas. The latter is in no way associated with the brands that it sells. The Buyer wishes to purchase certain Items ("Item") as may be showcased and described on our Services. It is the Libas's sole consideration to display or remove the displayed Item depending on its availability or non-availability. Libas shall not be liable to inform and alert the Buyer before removing and adding such an Item. Libas wishes to sell the Item on behalf of a Seller, a matter that is subject to the Buyer agreeing to the following purchase terms:
a) The Buyer acknowledges that Libas's authentication process is in-house and independent of any brand association of any kind or nature. Brands figuring on the application are not involved in the authentication of the Item being sold, and none of the brand owners or Sellers shall assume or own any responsibility for any Item purchased through the Services.
b) As a courtesy to the buyer, Libas may provide item descriptions and condition details through various online or offline communication channels. However, these descriptions are not guarantees or warranties. Buyers should note that all items are sold 'as is'.
c) A Buyer who wishes to cancel an installment ("Tabby") order has to contact us.
d) If a buyer receives an item that has been inaccurately described or misrepresented despite being authenticated by our team, they must submit a claim to customer support within 3 days of delivery. If the claim is verified with supporting evidence, the buyer will receive a full refund.
e) Claims will not be accepted for items that have not undergone physical authentication. In such cases, we are not liable for any discrepancies in the item's description and will not consider claims regarding its authenticity.
f) Libas has the right to reject any Items submitted if they're coupled with unclear images, images taken from the internet, or images that do not show the Item's label or defining features.
g) Libas is entitled to reject any Item with descriptions that do not match their showcased image or stated condition.
h) Communicating with buyers outside of the platform can lead to account suspension or termination, as well as put your personal information and security at risk. All communication and transactions should be kept within the Libas Services.
Buyer Shipping Fees
The Libas community is made up of buyers and sellers from all over the world. We constantly work with couriers to secure the best shipping rates for our community. If you choose to skip the shipping with included physical authentication, you'll enjoy quicker delivery and also reduce the carbon footprint of your purchase. If you order several items, the shipping costs for each will be calculated separately and then added up. Please note that shipping and handling costs depend on the final destination or the location of the nearest authentication center. The buyer shall bear all duties and taxes, which vary according to the type of item being imported and the country it is being imported into. Libas may be unable to estimate these duties at the time of purchase, as they are influenced by various factors and subject to frequent regulatory changes.
Value-Added Tax (VAT)
United Arab Emirates (UAE) has committed to implement VAT starting 1 January 2018. With a standard rate of 5%, VAT will apply to most of the supplies of goods and services supplied from this date. Businesses/individuals in UAE are required to comply with the new VAT rules and obligations - charge VAT, issue tax invoices, file periodical VAT returns and pay VAT when due to the tax authorities.
Libas also has to follow the rules and obligations for VAT set by the Governments in UAE. All prices shown on Libas website are inclusive of VAT for customers from the UAE. The exact VAT applicable to your order will be calculated upon checkout based on the selected delivery destination. In addition, for orders delivered outside the UAE local import taxes may be applied to your order and these will be shown at checkout.
Currency Conversion Fee
When sellers list items on Libas, the original price is set based on their local currency. As a buyer, you can view prices in any of our supported currencies, with the price converted depending on your chosen currency. When you view an item using a different currency from the seller's, the displayed price automatically includes a currency conversion fee (up to 5%).
If you change your chosen currency to match the seller's, you can view and purchase the same product at a price that does not include currency conversion fees. However, your card issuer or bank may add currency conversion and foreign exchange fees during the transaction, depending on their policies for such transactions. For example, if you use a UAE credit card to purchase an item displayed in AED, we will not charge currency conversion fees, but your card issuer may charge you for other fees separately.
Return Policy
If you've changed your mind about an item, you may relist it for sale on Libas Collective within 3 days of delivery. This comes with zero commission fees—only a payment processing fee of up to 3% will apply. If an item has passed Libas Collective's physical authentication but does not match its description upon arrival, please contact us within 3 days of delivery. After a thorough review, if the issue is confirmed, we will provide a prepaid return shipping label and issue a full refund. All items that undergo physical authentication are also verified using at least one third-party authentication service—sometimes two—and are fingerprinted prior to shipping. For this reason, we do not accept claims related to authenticity once an item has passed our authentication process, nor do we accept claims if the reported issue is not consistent with the item's fingerprint and documentation at the time of shipping. Returns are not accepted for items that have not been physically authenticated by our team. In such cases, we cannot take responsibility for inaccuracies in the listing or claims regarding authenticity. Unless covered by the conditions above, all sales are final and not eligible for return.
If an item has been physically authenticated by our team but does not match its description upon arrival or if you have concerns about its authenticity, please contact us within 3 days of delivery. After a thorough investigation, if the issue is verified, we will provide a prepaid shipping label for the return and issue a full refund.
Returns are not accepted for items that have not undergone physical authentication. In such cases, we are not responsible for discrepancies in the item's description and will not process any claims regarding its authenticity.
Except for the scenarios described above, please note that all sales are final and not eligible for return.
Refunds
If your item is eligible for a refund, the balance will be credited to your Libas Wallet, regardless of your original payment method. You can then choose to withdraw the funds or use them for another purchase.
The amount credited will be for the full value of the Item(s) and shall not include any payment processing fees, return processing fees, shipping costs, vouchers, customs taxes, duties taxes, vat taxes, and/or any other local taxes paid by the Buyer.
Withdrawing Funds
If your item undergoes authentication, the payment will be deposited into your wallet once Libas completes the process, typically within 5 business days. If your item is shipped directly to the buyer, the payment will be deposited 72 hours after delivery, provided there are no issues.
To withdraw funds, go to "My Wallet", tap "Add Recipient", and enter your bank details along with a clear, valid photo of your ID. Once you submit a withdrawal request, our team will process the bank transfer within 1-2 business days. The transfer may take up to 7 business days, depending on your bank's country of origin.
Withdrawals below $300 USD (or the equivalent in local currency) are not permitted, as this is the minimum withdrawal amount, aligned with our policy that no items can be sold for under $300 USD (or the equivalent in local currency).
Primarily Terms
From time to time, Libas may offer special promotional offers which may or may not apply to you. You agree to be compelled to any additional TC for these special offers. The United Arab Emirates laws shall govern these TC and the relationship between you and Libas. The failure of Libas to act in respect to a breach by you or others does not mean it surrenders to acting in respect to subsequent or similar breaches. Libas does not guarantee it will act against all breaches of these TC. There shall be no third-party beneficiaries of these TC unless expressed explicitly otherwise. These TC constitute the entire agreement between you and Libas and govern your use of the Application, superseding any prior agreements between you and Libas in respect to the Application.
Liability Limitation
As a client or user, you expressly understand and agree that Libas and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors shall not be liable to you for any direct, indirect, incidental, special and consequential damages, including, but not limited to, inaccurate pricing due to human error, technical error or bug, software glitches, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from the use of the Services.
Indemnity: Protection and Restitution
You agree to indemnify and hold Libas (officers, directors, agents, subsidiaries, joint ventures, and employees) harmless from any claim or demand, including reasonable attorneys' fees, or arising out of or related to your breach of these TC, or your violation of any law or the rights of a third party. Any dispute or claim arising out of or in connection with the Services shall be governed and interpreted by virtue of the United Arab Emirates laws, given that our headquarters is in Dubai.
Electronic Payment And Communication
We accept payments with most major credit and debit cards, Tabby, Tamara and Apple Pay. Libas Collective accepts payments via cryptocurrency through our designated payment partners. Once payment is confirmed by our cryptocurrency partner, the equivalent amount will be credited to your Voucher Balance. In accordance with anti-money laundering (AML) regulations and to ensure the security of all transactions, funds originating from cryptocurrency deposits are non-withdrawable, non-refundable, and may only be used to purchase goods on the portal. Cash or cash-on-delivery payment option is not available. When you use the Services or send emails to Libas, you are communicating electronically. You consent to receive communications from Libas electronically. Libas will communicate with you by email. You agree that all agreements, notices, disclosures, and other communications that we submit to you electronically meet any legal requirement that such communications be in writing.
Services Approved Email and Postings
The Services may provide Users with the ability to send messages to other Users and non-users and to post messages on the Services. Libas shall be under no obligation to review any messages, information, or content ("Postings") on the Services by Users and shall assume no responsibility or liability related to any such Postings. You understand and agree not to use any functionality provided by the Site and the Application to post content or initiate communications that contain. Any threatening, unlawful, harassing, abusive, vulgar, malicious, hateful, improper, racially, ethnically, or otherwise objectionable material of any kind, including any material which encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national or international law.
Advertisers Affiliate Programs
By joining any external or internal Libas affiliate program you can earn up to 5% commission on successful sales through your unique referral link (limited to maximum $500 USD per item). Commissions are paid monthly via approved methods, excluding taxes, shipping, and discounts. Affiliates must ethically promote Libas, avoid misleading tactics, and cannot run paid ads using Libas name without approval. Fraudulent transactions, self-referrals, or coupon abuse will result in termination. Orders that are canceled, refunded, or disputed will not qualify for commissions. Libas reserves the right to modify or terminate the program and remove inactive or non-compliant affiliates.
Advertisements and Solicitations
In this regard, you can't: Impersonate others or submit any kind of false information; Share personal information, such as messages which state phone numbers, social security numbers, account numbers, addresses, or employer references; Share messages by non-spokesperson employees of Libas claiming to speak on behalf of Libas, containing confidential information, or expressing opinions concerning Libas; Share messages that offer unauthorized downloads of any copyrighted or private information; Share multiple messages placed within individual folders by the same user mentioning the same subject.
Chain Letters
Chain letters are substantially similar or identical messages to multiple recipients advertising any product or service, expressing a political or other similar message, or any other type of unsolicited commercial message. This prohibition includes but is not limited to: Using Libas invitations to send messages to people who don't know you or who are unlikely to recognize you as a known contact; Using Libas to connect with people who don't know you and then sending unsolicited promotional messages to these direct connections without their own permission; Sending messages to distribution lists or newsgroup aliases.
Links
The Services or third parties may provide links to other World Wide Web sites. Libas has no control over such sites, and users acknowledge and agree that Libas shall not be responsible for the availability of such external sites or resources. Also, Users confirm that Libas shall neither endorse nor be responsible or held liable for any content, advertising, products or other materials available from such sites or resources.
Access to Password Protected/Secure Areas
Access to and use of password protected and/or secure areas of the Services is limited to authorized Users only. Unauthorized individuals attempting to access these areas of the Application may be subject to pursuance.
Interest Change
Libas reserves the right to make changes to the Services, policies and agreements thereto, and this TC at any time. Should you wish to terminate your account due to a modification to the TC, you should contact us.
Trademarks
Trademarks, logos, and service marks ("Marks") displayed on the Services are property of Libas Collective. Users are prohibited from using any Marks for any purpose including, but not limited to, use them as metadata tags on other pages, applications, or sites on the World Wide Web without the written consent of Libas Collective Trading LLC. All information and content, including any software programs available on or through the Services ("Content"), is protected by copyright. Users are prohibited from transmitting, modifying, displaying, copying, distributing, publishing, licensing, selling, creating derivative works from, or using any Content available on or through the Application. Libas is not associated with any of the brands it sells; these brands are registered trademarks of their respective owners and not affiliated with Libas Collective Trading LLC.
Procedure for Claims of Conceptual Property Violation
Libas respects the conceptual property of others, and we ask our Users to do the same. Libas is entitled, in appropriate circumstances and at its consideration, to disable and terminate the accounts of Users who may be violating the conceptual property of a third party. If you believe that your work has been copied in a way that constitutes copyright violation, or your conceptual property rights have been otherwise breached, please provide the Customer Support team with the following information: An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright; A description of the copyrighted work or other conceptual property that you claim has been violated; A description of where the material that you claim is causing violation is located on the Application; Your address, telephone number, and email address; A personal statement of goodwill that the disputed use is not authorized by the copyright owner, its agent, or the law. Libas agent for notice of claims of copyright or other conceptual property violation can be reached via the contact us form on our website.
Authentication and Counterfeit Items
Our authentication team independently conducts the Item's authentication by using the latest technology at one of our centers. Our aim is to guarantee that every purchased Item is authentic following a 3-layer authentication process, to ensure a hassle-free shopping experience. Indeed, if an order is placed on an Item that is then checked and deemed inauthentic by our team, the transaction shall be canceled, and the Buyer will not be charged for the Item. In addition, any and all Items deemed inauthentic will either be returned to the Seller at their own expense (including shipping and customs) or destroyed. Libas encourages all Sellers to list transparent, clear, and detailed descriptions regarding any Items submitted for sale to avoid any misrepresentation or misinformation. If the item is found to be inauthentic or misleading, you will be issued a full refund within 3 days of purchase. Libas has no association and/or affiliation with the brands whose items are offered for sale on its Libas platforms. All authentication is performed independently by Libas. The authentication services provided by Libas do not reflect the opinion of any brand, whether named directly or indirectly, and should not be regarded as such. Being a third-party institutional appraisal, the company abstains from involvement in any sales disputes. If there are any objections to the authentication results, contact us to submit your claim with supporting evidence.
Product Descriptions and Pricing
Libas does not guarantee that product descriptions, attributes, specifications, price, or other content, or any other information related to the products are accurate, complete, reliable, present-day, or error-free. Pricing is determined entirely by the Sellers. Libas reserves the right to object to the publishing of an article if the choice of pricing is deemed exorbitant.
Delivery
Libas may fail to successfully deliver Items because of a mismatch in live inventory listings with its partners. In such cases, Libas may cancel such orders if an Item is unavailable and carry out a full refund if the order has been paid for. The placement of an order does not guarantee the delivery of an Item. Libas shall not be liable for delays in orders because of customs clearance at destination. Libas will not deal or submit any services or products to any "OFAC" sanctioned countries, in accordance with the law of the UAE. Regulations may prohibit the importation of Items made with exotic materials to certain countries. Please contact us for more information.
Loss or Damage
Following delivery, Libas shall maintain adequate insurance coverage for the consigned merchandise including risks of fire, flood, theft, and damage. All risk of loss or damage to the merchandise in return transit up till the Item is delivered to Libas shall be borne by the Buyer. If the condition of the Item is re-evaluated to be poorer than the earlier estimate, Libas reserves the right to reduce the payout amount for the Item.
Warranty and Disavowal
All content, products, and services are provided to you without warranty of any kind either expressly or implicitly including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose, title, absence of infringement, security, or accuracy. Libas shall neither endorse nor be responsible for the accuracy or reliability of any opinion, advice, or statement made through the Services by any party other than Libas. It also refrains from seconding any content provided on linked sites or the capabilities or reliability of any product or service obtained from a linked site, any technical or human errors that arise from software, tech, information technology, bug, malware, virus attack, or hack. Other than what is required under the applicable consumer protection law; under no circumstance shall Libas be liable for any loss or damage caused by a User's reliance on information obtained through an application or a linked site or a User's reliance on any product or service obtained from a linked site. It is the responsibility of the User to evaluate the accuracy, completeness, or usefulness of any opinion, advice, or other content available on the Services or obtained from a linked site. Please seek appropriate professional advice regarding the evaluation of any specific opinion, advice, product, service, or other content. Libas does not guarantee, undertake, and represent the quality of the goods and Items sold. Libas offers a lifetime authenticity guarantee for all Items sold on its Services. In the rare case of having a sold Item found and proven to be inauthentic through enough supporting evidence, the Buyer will receive a full refund, including the cost of the return shipment.
After-Agreement Termination Terms Effectiveness
Any clause in these TC that imposes or anticipates ongoing responsibilities on a party will remain in effect after these TC expire or are terminated, regardless of any other clauses or general legal principles to the contrary.
Laws and Jurisdiction
Upon using our Services, you shall confirm that you are either at least 18 years of age or accessing the Services under the supervision of a parent or legal guardian. You shall be referred to as a user ("User") and your acceptance of these TC and all applicable laws shall be deemed effective once using any functionality of the Services. You're entitled to use certain sections of the Services if you are a registered User only.
